These Terms of Service ("Terms") form a binding agreement between you ("you," "your," or "User") and AIFusion, a registered partnership firm established in the People's Republic of Bangladesh ("AIFusion," "we," "us," or "our"), governing your access to and use of https://aifusion.space and all related applications, features, and services (collectively, the "Service").
By creating an account, purchasing Credits, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

"Account" — your registered user account on the Service.
"Credits" — prepaid usage units used to access designated AI features. Credits are a limited licence to use the Service and are not money, currency, a payment instrument, or cash-equivalent value.
"Free Credits" — Credits issued at no charge for evaluation or promotional purposes.
"Paid Credits" — Credits purchased for consideration through Paddle or bKash.
"Input" — text, prompts, documents, files, or other content you submit to the Service.
"Output" — content generated by the Service in response to your Input.
"User Content" — Inputs and Outputs collectively.
"AI Providers" — the third-party model providers integrated into the Service.
"Paddle" — Paddle.com Market Limited and, where applicable, another Paddle group entity acting in the relevant transaction as Merchant of Record.
The Service is available only to individuals aged 18 or over. By using the Service you represent and warrant that:
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to both you and that organisation.
We may terminate any Account we reasonably believe is held by a person under 18, without refund of Free Credits and subject to any applicable rights concerning Paid Credits.
You must provide accurate, current, and complete information when creating an Account and keep it up to date.
You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your Account. Notify us promptly at aifusionsite@gmail.com if you suspect unauthorised access.
You may not maintain multiple Accounts to obtain additional Free Credits, evade rate limits, or circumvent enforcement action. Doing so may result in termination or restriction of all associated Accounts.
Accounts and Credits are personal to you and may not be sold, transferred, assigned, gifted, or shared.
Providing false registration information, impersonating another person, or using an Account on behalf of a suspended or terminated user is a material breach of these Terms.
AIFusion provides a unified software interface to third-party AI models through direct API integrations under our own commercial agreements. AIFusion does not provide or resell raw third-party API access, API credentials, or model endpoints to Users.
AIFusion is a software platform. Available models and AI-powered features may change over time.
As of the Effective Date, we may integrate providers including:

The specific models and features available to you may vary by location, account, availability, technical limitations, provider requirements, and AIFusion's internal policies.
AIFusion is not affiliated with, endorsed by, sponsored by, or acting as an authorised representative of any AI Provider, Paddle, or bKash unless expressly stated otherwise.
All trademarks and model names belong to their respective owners and are used descriptively.
Your use of AI-powered features may also be subject to applicable terms, usage restrictions, and safety policies imposed by the relevant AI Provider.
You agree not to use AIFusion in a manner that would cause AIFusion to breach its agreements with its AI Providers.
AIFusion does not currently provide user-uploaded image-reference or face-reference functionality for image or video generation.
Image and video generation features may therefore be limited to text-based prompts and other permitted inputs supported by the applicable feature.
We may add, modify, restrict, or remove features in the future.
Certain features may be unavailable in particular countries or regions due to legal, regulatory, contractual, technical, or provider requirements.
Features powered by Kuaishou or ByteDance may transmit Input to infrastructure located in the People's Republic of China. Where such features are restricted in particular jurisdictions, you must not use a VPN, proxy, IP-masking service, or other means to circumvent those restrictions.
Models, providers, and features may be added, modified, suspended, restricted, or removed at any time, including where an AI Provider changes its pricing, terms, policies, technical requirements, or availability.
We do not guarantee the continued availability of any particular model or feature.
Where reasonably practicable, if a model is permanently removed and an equivalent use of the relevant Credits is no longer reasonably possible, AIFusion may provide an appropriate alternative or other remedy as described in Section 8.
The Service operates on a prepaid Credit system. Credits are consumed when you use AI features.
Different models and features may consume different quantities of Credits, as displayed in the Service before or during use.
Credits represent prepaid access to designated AIFusion features. Credits:
We may change the Credit cost of any feature, including where an AI Provider changes its own pricing.
Changes apply prospectively only and do not retroactively alter Credits already consumed.
Material pricing changes affecting future purchases may be communicated through the Service, website, or other reasonable means.
Free Credits are provided for evaluation, promotional, or other no-charge purposes. Free Credits:
Paid Credits remain valid indefinitely from the date of purchase, unless otherwise stated at the time of purchase or required by applicable law.
Credits may also be forfeited when an Account is deleted or terminated in accordance with Section 7 or Section 13.
If Credits are consumed because of a verified technical failure and no proper Output was delivered, AIFusion may restore the Credits consumed in accordance with Section 8.
Credits will not ordinarily be restored merely because you are dissatisfied with the quality, style, accuracy, usefulness, or content of an Output that was successfully generated and delivered.
To limit unnecessary data retention, Accounts are deleted after a period of inactivity:

"Inactivity" means no sign-in and no use of any AI feature during the relevant period.
Where feasible, we will email your registered address before deletion.
It is your responsibility to keep your email address current and to ensure our messages are not filtered.
Deletion permanently removes your conversations, uploaded files, Outputs, preferences, and any remaining Credit balance, subject to any retention required by law or described in our Privacy Policy.
Deletion is not reversible.
If you hold unused Paid Credits and are notified of pending deletion, you may:

Paddle transactions. Purchases made through Paddle are processed by Paddle as Merchant of Record.
Our order process for Paddle transactions is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for orders processed through Paddle. Paddle provides payment-related customer support and handles returns and refunds in accordance with its policies and applicable law.
AIFusion remains responsible for providing the software service and product support associated with AIFusion.
Bangladesh transactions. Customers accessing the Service from Bangladesh may pay through bKash Limited. bKash payment functionality is displayed only to customers accessing the Service from Bangladesh and is not offered as the international payment method.
AIFusion may use reasonable technical and geographic controls, including IP-based location determination, to determine which payment options are displayed.
No card data. AIFusion does not receive or store your full payment card number, CVV, or bKash PIN.
AIFusion sells one-off Credit packs. There is:
You will not be charged again unless you independently make another purchase.
AIFusion's standard remedy for a verified technical generation failure is restoration of the Credits consumed, rather than a cash refund.
Where Credits were consumed because a generation failed due to a technical malfunction, processing failure, or other material failure of the Service and no proper Output was delivered, we may restore the Credits consumed.
To request Credit restoration, contact aifusionsite@gmail.com and provide sufficient information for us to investigate the failed generation, including where available:
We may request additional evidence reasonably necessary to verify the claim.
Credit restoration is intended for genuine technical failures and is subject to verification.
Credits will not ordinarily be restored merely because:
Except where required by applicable law, required by Paddle's applicable policies, or otherwise determined by Paddle, AIFusion does not offer general cash refunds for Credits simply because a User is dissatisfied with the Service or an Output.
Our standard remedy for a verified failed generation is Credit restoration.
Nothing in these Terms excludes, restricts, or waives any mandatory consumer rights or remedies that cannot legally be excluded.
For transactions processed through Paddle, Paddle may independently determine whether a refund is appropriate under its Buyer Terms, Refund Policy, applicable law, or other applicable requirements.
Where Paddle issues a refund, AIFusion will honor that determination.
Where a paid product or service is materially defective, not delivered, or otherwise subject to a mandatory refund right under applicable law, the applicable legal or payment-provider remedy will apply.
Where appropriate, AIFusion may first attempt to resolve the issue by restoring the relevant Credits or otherwise correcting the technical problem.
If you believe you were charged more than once for the same purchase, or a payment was unauthorized, contact us promptly at aifusionsite@gmail.com.
Nothing in these Terms limits your lawful right to dispute an unauthorized transaction with your bank, card issuer, payment provider, or other relevant authority.
We encourage Users to contact AIFusion for Paddle transactions.
Where a chargeback or payment dispute is initiated, we may temporarily suspend access to the relevant Account or purchased Credits while the matter is investigated, subject to applicable law.
We may take appropriate action where we reasonably believe a payment dispute involves fraud, abuse, or manipulation of payment systems.
This does not affect your lawful rights concerning genuinely unauthorized transactions or consumer disputes.
Prices are displayed in the currency shown at checkout.
Where your payment method is denominated in a different currency, your bank or payment provider may apply its own exchange rate and foreign-transaction fees.
For Paddle transactions, the final transaction amount and applicable taxes are presented through Paddle's checkout.
You retain whatever rights you hold in your Inputs.
AIFusion does not claim ownership of your original content merely because you submit it to the Service.
You grant AIFusion a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, display, and process your User Content solely as necessary to:
This licence is limited to these purposes and terminates when the applicable content or Account is deleted, subject to legally required retention and the retention periods described in our Privacy Policy.
AIFusion does not use your Inputs, Outputs, or conversations to train, fine-tune, or improve AI models, except where expressly disclosed otherwise in the Privacy Policy and permitted by applicable law.

You represent and warrant that you hold all rights, licences, permissions, and consents necessary to submit your Inputs and that your Inputs do not infringe any third-party right or violate applicable law.
You are responsible for keeping your own copies of important Outputs.
We do not guarantee permanent availability of stored content, and Section 7 provides for deletion following inactivity.
As between you and AIFusion, and to the extent permitted by applicable law and the applicable AI Provider's terms, you may use Outputs generated for you for personal or commercial purposes, subject to these Terms.
No guarantee is made that copyright or other intellectual property rights will arise in any particular Output.
AI models are probabilistic.
Identical or similar Inputs may produce identical or substantially similar Outputs for different Users.
We do not warrant that any Output is unique, original, or exclusively available to you.
The legal status of AI-generated content varies by jurisdiction.
Some AI-generated material may not qualify for copyright protection, while other material may contain protectable human-authored elements or third-party material.
We make no representation that any Output is protectable, or that its use will not infringe a third party's rights.
You are responsible for obtaining appropriate legal advice before using Outputs where intellectual-property rights are important.
AI Outputs may be inaccurate, incomplete, outdated, biased, offensive, or entirely fabricated.
AI systems may confidently generate false information, including fabricated facts, citations, quotations, statistics, legal claims, and historical claims.
You must independently verify Outputs before relying on them, publishing them, distributing them, or using them to inform any decision.
Outputs do not constitute medical, legal, financial, tax, psychological, safety, or other professional advice.
Do not use the Service as a substitute for a qualified professional.
Do not use the Service for emergency, crisis, medical-diagnosis, life-safety, or other situations where an incorrect Output could reasonably result in serious harm.
You are responsible for complying with applicable laws, regulations, contractual obligations, platform rules, and professional standards concerning disclosure or labelling of AI-generated content.
You agree not to use the Service, and not to permit anyone else to use your Account, for any prohibited purpose described below.
AIFusion provides image-reference, character-reference, and other reference-media functionality for certain supported image and video-generation features. These features may allow an Input image or other reference material to influence the appearance, identity, composition, character, or visual characteristics of generated content.
Reference functionality is intended for lawful and authorized creative uses.
You are responsible for ensuring that you have all rights, permissions, licenses, and consents required to submit reference material and use the resulting Output.
You must not use the Service to:
Where you submit reference material depicting another identifiable person, you represent and warrant that you have obtained any consent, authorization, license, or other legal basis required for that specific use.
Certain AI Providers or features may impose additional requirements for real-person references, including identity verification, documented authorization, or other restrictions. You agree to comply with all such requirements.
AIFusion may request information reasonably necessary to investigate a reported violation or determine whether continued access to a feature should be restricted. Users must not submit unnecessary identity documents or other sensitive information unless specifically requested through an appropriate support process.
AIFusion may use automated safety systems, provider-level safeguards, account-level controls, moderation, and reports from Users to identify potentially prohibited synthetic-media content.

Because automated safety systems are imperfect, AIFusion does not guarantee that every prohibited generation will be automatically detected or blocked.
The availability of a reference-image or likeness-related feature does not mean that every possible use of that feature is permitted.
You remain responsible for your Inputs, Outputs, and use of the Service.
You must not use the Service to create, upload, or distribute content that:

Unless an appropriate Data Processing Agreement or other written arrangement is in place, you must not submit:
Do not submit sensitive personal information unless you have a lawful basis and all required rights, permissions, and safeguards are in place.
You must not use the Service, without appropriate human oversight, independent verification, and lawful safeguards, to make or materially inform decisions concerning:
Where applicable law imposes stricter requirements, those requirements prevail.
AIFusion may operate automated safety and abuse-prevention controls alongside applicable AI Provider safeguards.
These controls may screen Inputs, uploaded files, Outputs, metadata, and account activity.
A request may be blocked, delayed, reviewed, limited, or flagged.
Flagged content and associated information may be retained and reviewed as described in our Privacy Policy.
Automated screening is not perfect. The absence of a block does not mean that content is permitted under these Terms.
To report content or activity that violates these Terms, depicts you or another person without appropriate consent, or infringes your rights, contact aifusionsite@gmail.com.

Reports involving child sexual abuse material, non-consensual intimate imagery, credible threats of serious violence, or other serious safety issues may be prioritized.
Where appropriate, we may preserve relevant information and cooperate with lawful requests from competent authorities.

We may take immediate action where necessary to prevent serious harm, fraud, abuse, security threats, or violations involving prohibited content.

We are not required to restore content or access where doing so would create legal, safety, security, payment-provider, or AI-provider risks.
Creating a new Account or otherwise attempting to circumvent an enforcement action is prohibited.
You may stop using the Service and request deletion of your Account at any time.
We may suspend or terminate your Account if:

Except where required by applicable law or payment-provider requirements, Credits associated with an Account terminated for material violations of Section 11 are not refundable.
The Service, including its software, interface, branding, design, documentation, non-user content, system architecture, workflows, and underlying technology, is owned by or licensed to AIFusion and is protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for its intended purposes.
This licence ends when your right to use the Service ends.
You may not copy, reproduce, redistribute, sell, lease, sublicense, modify, reverse engineer, or create derivative works of AIFusion's proprietary software or materials except where expressly permitted by law or by us in writing.
If you voluntarily provide feedback, suggestions, or ideas concerning AIFusion, you grant us the right to use that feedback without compensation or attribution, provided that doing so does not disclose your confidential information.
The Service may depend on third-party services, including AI providers, hosting providers, payment processors, authentication services, storage providers, analytics services, and other infrastructure providers.
Third-party services may have their own terms and policies.
AIFusion does not control and is not responsible for the independent operation, availability, policies, or content of third-party services.
Where a third-party service becomes unavailable or changes its terms or technical requirements, AIFusion may modify or discontinue the affected functionality.
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.
We do not warrant that:
AI systems are experimental and probabilistic in nature.
You are responsible for evaluating Outputs before relying on them.
Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded.

When we make material changes, we may provide notice through the Service, our website, email, or another reasonable method.

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
For purchases, the version of the Terms applicable to the relevant transaction may govern that transaction, subject to mandatory law and any applicable payment-provider terms.
We may modify, suspend, or discontinue all or part of the Service at any time. This may include changing:

If we permanently discontinue the Service and applicable law requires a refund of unused Paid Credits, we will comply with that requirement.
Otherwise, no automatic cash refund is guaranteed for unused Credits.
These Terms are governed by the laws of the People's Republic of Bangladesh, except to the extent that mandatory consumer-protection laws in your jurisdiction provide otherwise.
Before bringing a formal legal claim, you agree to first contact aifusionsite@gmail.com and provide a reasonable opportunity for us to attempt to resolve the dispute.
Nothing in this Section prevents you from exercising mandatory statutory rights, bringing a consumer complaint to a competent authority, or pursuing remedies that cannot legally be waived.
To the extent permitted by applicable law, courts of competent jurisdiction in Bangladesh will have jurisdiction over disputes arising from or relating to these Terms.
These Terms, together with the Privacy Policy and other policies expressly incorporated by reference, constitute the agreement between you and AIFusion concerning your use of the Service.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Our failure to enforce a provision of these Terms does not constitute a waiver of our right to enforce that provision later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations as part of a merger, acquisition, restructuring, sale of assets, or similar transaction.
We are not responsible for delays or failures caused by events beyond our reasonable control, including outages affecting third-party AI providers, hosting providers, telecommunications networks, payment processors, natural disasters, war, civil unrest, government actions, or other force-majeure events.
